Legal battle over Trump’s Venezuelan deportations reignited in court hearing

A crucial court hearing is set to take place on Thursday before U.S. District Judge James Boasberg, where immigration lawyers and the Trump administration will present new information and arguments in a significant immigration case during President Donald Trump’s second term.

Boasberg has not yet indicated which issues he will address during the hearing.

This hearing follows Boasberg’s temporary restraining order issued on March 15, which aimed to prevent Trump from using the Alien Enemies Act to quickly deport hundreds of Venezuelan nationals to El Salvador earlier this year, sparking a series of legal challenges across the country.

As a result of Boasberg’s order, the Supreme Court ruled that the rushed deportations violated migrants’ due process rights under the U.S. Constitution.

Boasberg is at the center of this legal controversy, and the hearing on Thursday could reignite the contentious court battle.

Plaintiffs are seeking to reopen limited discovery based on new evidence, including a recent UN report and a whistleblower report from a former Justice Department attorney.

The Trump administration has criticized Boasberg as an “activist judge” and tensions escalated earlier this year when Boasberg found probable cause to hold the administration in criminal contempt for not complying with his emergency order.

In June, Boasberg ordered that non-citizens deported to a maximum-security prison in El Salvador be given the opportunity to challenge their alleged gang status in court.

The hearing on Thursday comes amidst new reports and allegations filed by plaintiffs in an effort to reopen discovery.
