A prominent pro-business organization is set to take action on Monday in support of the federal government as California leads a coalition of states attempting to reverse Congress’ removal of several electric vehicle (EV) mandates.
The American Free Enterprise Chamber of Commerce (AmFree), a group advocating for limited government, plans to file a lawsuit in Oakland federal court to intervene in California’s challenge to three bipartisan resolutions passed by Congress that halted the enforcement of what AmFree describes as “extreme” and economically harmful EV mandates.
According to AmFree, California and other states involved in the lawsuit are prohibited from enforcing the mandates, and these regulations were detrimental to American businesses. The organization argues that the Congressional Review Act (CRA), which was used to block the mandates, prevents any judicial review of the situation.
AmFree CEO Gentry Collins praised President Trump and Congress for rejecting California’s EV mandates, stating that these regulations would have had a disastrous impact on the U.S. economy. The organization believes that California lacks standing to challenge the CRAs and that courts should not interfere with congressional processes.
The lead attorney in the case, Michael Buschbacher, emphasized that the law is clear regarding challenges to CRAs and stated that the blue-state plaintiffs are attempting to push the judiciary beyond its boundaries. He also mentioned that having AmFree and its trade association partners as intervenors helps prevent any collusive settlements.
California Governor Gavin Newsom and Attorney General Robert Bonta defended their lawsuit against the federal government, accusing the Trump administration of undermining California’s authority to maintain stricter clean vehicle standards. Newsom and Bonta vowed to continue fighting for California’s environmental policies despite opposition from the federal government.
Several states, including Pennsylvania, have adopted California’s EV mandates, while Virginia was able to break away from the pact.
