The legal team representing Sean “Diddy” Combs has requested his release from jail on Tuesday.

Combs, who was convicted on federal charges related to transportation for prostitution on July 2, is still in custody. His legal team is seeking his release until his sentencing hearing scheduled for Oct. 3.

The rapper, known for hits like “I’ll Be Missing You,” was cleared of more serious charges such as racketeering and sex trafficking. Combs’ lawyers argued that his lifestyle involving consensual relationships with his ex-girlfriends should not be a reason to keep him detained after being acquitted.

“This was a lifestyle choice made by all parties involved. They were consenting adults who had the right to make these decisions,” stated the petition for release obtained by Fox News Digital. “Like any romantic relationship, there were complexities, moments of jealousy, and frustrations. However, these were serious and long-term romantic relationships.”

Combs’ legal team claimed that the circumstances of his case make his continued prosecution and incarceration “unprecedented.”

“There has never been a case like this where a person and his girlfriend arranged consensual adult relationships with other men as part of a ‘swingers’ lifestyle, leading to prosecution and imprisonment under the Mann Act,” the letter stated.

Judge Arun Subramanian denied Combs’ proposed $1 million bail package immediately after his conviction. The judge cited Combs’ history of violence in personal relationships as a factor in his decision to keep the rapper in jail.

According to Judge Subramanian, releasing Combs would pose a safety risk to others.

For his latest request for release, Combs’ legal team proposed a $50 million bail package secured by his Miami mansion. The conditions included restrictions on travel and surrendering his passport.

“Sean Combs should not be imprisoned for these actions. In fact, he may be the only person currently in jail in the United States for hiring any kind of escort, and certainly the only one in jail for hiring adult male escorts for himself and his girlfriend without engaging in sexual activity with the escort,” emphasized the lawyers.

During a press conference after the verdict, Combs’ lead counsel, Marc Agnifilo, expressed determination to continue fighting for Combs’ freedom.

“We are not giving up. This is just the beginning. We will keep fighting until Combs is a free man with his family,” Agnifilo stated outside the courthouse. “Winning against the prosecutors from the Southern District of New York requires perseverance from start to finish. Today was a significant step in the right direction, but our fight is not over. We will win, and we will not rest until Combs walks out of prison a free man.”
