Expert warns banter between Blake Lively and Justin Baldoni could impact deposition

Blake Lively’s deposition is scheduled for Thursday as part of the ongoing legal battle with Justin Baldoni over allegations of sexual harassment on the set of “It Ends With Us.” Legal experts anticipate Baldoni’s team will use the deposition to challenge Lively’s claims and gather information to support their defense.

According to employment and defamation law attorney Camron Dowlatshahi, Baldoni’s team aims to highlight any inconsistencies in Lively’s accusations, particularly in light of videos showing her “flirting” and “joking” with Baldoni. Judge Lewis Liman has granted Lively the option to conduct her deposition at a location of her choosing.

Legal experts emphasize the significance of Lively’s deposition, noting that any statements she makes can be used against her in the case. Dowlatshahi predicts multiple deposition sessions may be necessary, with Baldoni’s team likely seeking additional opportunities to question Lively.

In December, Lively accused Baldoni and film producer Jamey Heath of sexual harassment, retaliation, intentional infliction of emotional distress, and negligence. Baldoni filed a lawsuit in response, claiming Lively’s allegations were false and part of an effort to salvage her reputation following controversies during the film’s press tour.

The legal proceedings have included the dismissal of Texas-based publicist Jed Wallace from the case and the withdrawal of subpoenas against three YouTubers. Lively’s legal team has also dropped claims of emotional distress against Baldoni.

Lively’s deposition presents Baldoni with a crucial opportunity to gather evidence and challenge her testimony. Entertainment lawyer Tre Lovell emphasizes the importance of Lively’s honesty during the deposition, as her statements are given under oath.

Former federal prosecutor Neama Rahmani suggests that Baldoni’s lawyers will focus on uncovering inconsistencies in Lively’s claims and using her text messages and prior statements to undermine her case. Preparation for the deposition likely involved extensive training to address potential objections and respond effectively to questioning.

Experts believe Lively’s legal team would have conducted mock depositions to prepare her for the proceedings, emphasizing the importance of answering questions truthfully and avoiding unnecessary information.
