A man from Guatemala who is residing in the U.S. illegally was arrested by Immigration and Customs Enforcement (ICE) agents shortly after being released by authorities in Rhode Island. This man, Josue Santiago Perez Gomez, was charged with various child sex crimes and had an active ICE detainer.

The charges against Perez Gomez include patronizing a minor for commercial sexual activity, indecent solicitation of a child, and procurement of sexual conduct for a fee, as reported by ICE.

The Portsmouth Police Department in Rhode Island arrested Perez Gomez on these charges on July 12. Despite ICE filing an immigration detainer, the police released Perez Gomez a few hours later, according to ICE.

The Portsmouth police did not respond immediately to inquiries from Fox News Digital.

Earlier that day, ICE Boston officers had already arrested Perez Gomez on immigration violation charges and had served him with a notice to appear before a Justice Department immigration judge.

An ICE spokesperson informed Fox News Digital that Perez Gomez is considered a significant threat to children.

“Josue Santiago Perez Gomez is accused of heinous crimes and poses a serious threat to the children in our Rhode Island communities,” stated ICE Enforcement and Removal Operations Boston acting field office Director Patricia Hyde. 

“Releasing an alleged child sex offender on the same day of his arrest raises the question: What is the purpose of the arrest? 

“Fortunately, ICE was able to remove this criminal from our streets where local authorities allowed him to potentially harm children.”

It remains unclear when Perez Gomez entered the U.S. illegally or where he crossed the border.

According to ICE, Perez Gomez was neither inspected, admitted, nor paroled by a U.S. immigration official.

Perez Gomez will remain in ICE custody until the conclusion of his removal proceedings, officials confirmed.
