TikTok influencer’s husband cleared of charges in son’s drowning

Following a tragic pool accident in Arizona, the husband of a popular TikTok influencer will not be facing charges after their 3-year-old son passed away.

Emilie Kiser was out with friends while her husband, Brady, was at home with their newborn, Theodore, and Trigg, 3, who unfortunately drowned, as reported by Fox 10. Trigg was found unresponsive in the family’s backyard pool in Chandler, Arizona, according to fire department officials.

“Upon arrival, Chandler PD found an unconscious 3-year-old boy who had been pulled from the backyard pool. Officers initiated CPR and firefighters took over patient care,” stated the fire department officials.

Brady informed police that he had briefly turned away, only to find his son floating in the pool moments later. Trigg tragically passed away six days after the incident.

On July 15, the Chandler Police Department recommended a Class 4 felony charge of child abuse against Brady Kiser in relation to the drowning death of his son, Trigg Kiser.

The Maricopa County Attorney’s Office, however, announced that no charges will be pursued against Brady, citing a lack of “likelihood of conviction.”

“To secure a conviction for this charge, the state must prove beyond a reasonable doubt to a unanimous jury that the individual failed to perceive a substantial and unjustifiable risk, and that this failure was a gross deviation from the standard of care expected from a reasonable person,” they explained.

Every case submitted to the Maricopa County Attorney’s Office is evaluated based on the likelihood of conviction. Following a thorough review of the evidence, it was determined that this case did not meet that standard.

The class 4 felony child abuse charge carries a potential penalty of 1 to 3.75 years in prison, with the possibility of probation.

Emilie took legal action to prevent the release of investigative and post-mortem records related to the incident involving her son.
